HHS Finalizes Updates to Research Misconduct Policies

The department offers process clarification and nuance to original 2005 regulation.

The Department of Health and Human Services (HHS) has finalized updates to its policies on research misconduct. This final rule clarifies the 2005 regulation that originally outlined HHS misconduct report tools and oversight responsibilities, offering clarity and nuance to accommodate new best practices and technologies.

“The research landscape has changed over the past 20 years, thanks to new technology, scientific advances, and the globalization of research,” said HHS Secretary Xavier Becerra. “To preserve the integrity of the research that we help to fund, it is necessary to update the regulations around how that research is conducted. And that is what we are doing today.”

A few major updates include confidentiality obligations required by research institutions, clearer descriptions for misconduct investigation requirements, and establishing an appeals process for misconduct found to be an honest mistake.
